Jurien Bay Accommodation
Reservations for short-term holiday accommodation are accepted by Jurien Bayview Realty ABN 97 700 429 816 of PO Box 64, Jurien Bay, WA 6516 (“the Booking Agent”) as agent for the Owner of the Property and to which bookings the following terms and conditions shall apply:
Changes to Holiday Bookings
Where possible, Jurien Bayview Realty will accept certain changes to a booking after a booking has been confirmed with a deposit. Changes such as moving from one property to another after the final payment has been made will only be possible under exceptional circumstances. In such cases an administration fee of $50.00 will be charged.
For all bookings 50% of the tariff plus a booking fee of $25.00 is required as a deposit to confirm the booking. This deposit is payable at the time you make the booking. The final balance of all outstanding monies is due fourteen (14) days prior to your arrival. Payment may be made by bank cheque (made payable to Jurien Bayview Realty), money order, EFTPOS, MasterCard, Visa, Online or direct deposit. If you would like to pay your monies via direct deposit into our trust account you can deposit monies into Bendigo Bank Jurien Bay in the name of Jurien Bayview Realty Trust Account, our BSB: 633-000 and our account number is 159003771. Please ensure that you put your surname as a reference so we know whom the funds have been deposited from. Thereafter a receipt will be raised for collection on your arrival. There is a 0.7% surcharge for credit card transactions.
Your holiday property is available from 2:00pm and keys to the property can be collected from our office upon arrival. An early check in time may be possible however this may only be authorised if it is requested by you PRIOR TO ARRIVAL and a $50.00 fee will be applicable. Please note that keys to the property will not be released until payment is received in full and the Holiday Rental Accommodation Security Bond Agreement Form is fully completed and returned to us. Only one set of keys will be given out per holiday property.
Check out time is strictly 10.00am on the date of departure. Any late departures must be arranged prior to your stay and will incur a late fee of $50.00. The keys to the property must be returned to Jurien Bayview Realty office upon vacating. Any late departures that are not pre-arranged will incur a late fee.
Once your booking has been confirmed and receipted by Jurien Bayview Realty your deposit is non-refundable. If the booking is cancelled in writing more than six weeks from the date of commencement of your holiday you will be released from the liability for the full balance of hire. The deposit is non-refundable.
If we receive written notice of cancellation less than six weeks prior to the date of commencement of your holiday and we are successful in finding guests to fill your place at the holiday home you will be released from the liability for the full balance of hire. The deposit will not be refunded.
If any unforeseen circumstances arise, which can include accident, ill health or any other matters beyond the Guest’s reasonable control, and the booking has been made and confirmed, the Guest will still be responsible for payment of the full rental whether or not occupation of the property occurs.
The holiday agreement is between the Guest and Jurien Bayview Realty, on behalf of the Owner of the Property for which the accommodation booking is made and is subject to the terms and conditions herein. The agreement for accommodation shall not be effective until the Booking Agent sends the Guest written confirmation of the booking. The Guest acknowledges that Jurien Bayview Realty acts as a booking agent for the Owner.
The accommodation booking will not be confirmed by the Booking Agent until the Guest’s deposit payment is received and cleared. If the accommodation booking is made within two (2) weeks of the date of commencement of the Guest’s proposed holiday, the full rental payable for the Property is required together with any bond, credit card information and any other payment applicable.
The full amount payable in respect of the Property rental shall be paid at least two (2) weeks prior to the date of commencement of the booking. If the full payment has not been received by the Booking Agent at least fourteen (14) days prior to the start of the rental period, then the Booking Agent and the Owner reserve the right to cancel the booking without notice and the Guest will forfeit the Guest’s deposit which will be non-refundable in such circumstances.
Noise & Neighbours
We want you to enjoy your stay but please be aware of the impact of your noise on others and keeping our neighbours happy is of paramount importance. Noise and music should not impact any other property and noise levels are to be respectful at all times. There is to be no outdoor music or outdoor entertaining after 10pm. Noise complaints will result in a possible eviction.
Guest’s Obligations in Respect of the Property
The Guest shall be responsible for the Property during the Guest’s stay. The Guest shall take all reasonable care of the property and at the end of the stay shall leave the property including all utensils, fixtures, fittings and equipment on or in the property in a clean and tidy condition. The Guest shall be liable for any extra cleaning, breakages or damage caused to the Property or any part thereof or any of the chattels therein that may occur during the Guest’s occupation of the Property and all costs for extra cleaning, repair and replacement thereof shall be payable to Jurien Bayview Realty. Any damage or breakage to any part of the Property or any of the chattels therein shall be reported to the Booking Agent as soon as practicable after the damage occurring thereto.
Pet Bookings: Terms and Conditions
Pets are only permitted at pet-friendly properties. Where pets are permitted the following rules must be followed;
- they are to be kept outside at all time.
- they are to be kept under control at all times.
- the guests are responsible for any damage caused by their pets.
- guests agree not to leave pets unsupervised or alone at the property at any time.
- pet bedding, food bowls and other pet items to be provided by guests
- they agree to dispose of pet faeces in a clean and sanitary manner
- an additional charge may be requested for pets, under specific circumstances
Neither Jurien Bayview Realty nor the Owners accept responsibility for pet safety. If extra cleaning is required because a guest had their pet inside the property, the guest will be charged. Additional pet restrictions may apply at some properties. These will be detailed in the property description. Guests should ensure that any arrangements in place for pets at a property, including these terms, are suitable for their pet prior to booking.
Additional Features (If Any)
The Guest acknowledges that the use of any additional amenities, for example bicycles, swings etc, is entirely at the Guest’s risk and neither Jurien Bayview Realty nor the Owner shall accept any responsibility for any injury, loss or damage to property or any third party arising from the use thereof. These amenities are to be respected and any damage reported to Jurien Bayview Realty.
All personal belongings, baggage, vehicles and other property of the Guest of any description shall be the risk of the Guest at all times and neither Jurien Bayview Realty nor the Owner accepts any responsibility for any loss or damage thereto.
Guest Numbers and Functions
The Guest may only allow the Property to be occupied by the number of persons nominated in the Guest’s application and under no circumstances shall the number of people occupying the Property be greater than that appearing on the Guest’s application or the booking confirmation, whichever is the lesser. Jurien Bayview Realty and the Owner reserve the right to refuse occupation of the Property to the Guest if the condition on the number of people intended to occupy the Property is not observed. Shire regulations allow holiday homes to be rented for accommodation purposes only and not as a function venue e.g. for a wedding or party. Functions and gatherings are not permitted and, if evidenced, may be closed down immediately and guests will be asked to vacate the premises, with no refund.
Right to Refuse or Revoke Bookings
Jurien Bayview Realty and the Owner reserve the right to revoke or refuse to honour any property accommodation booking which may in the opinion of either party (and at their sole discretion) be unsuitable for the Property concerned.
Once a Guest’s booking has been confirmed, the Guest shall be responsible for payment of the total price for the rental period and all extras (if any) as shown on the confirmation notice on or before the date or dates referred to in such notice.
The Guest acknowledges that Jurien Bayview Realty has used its best endeavours to describe the Property to the Guest within the limited extent of the communications between the Guest and Jurien Bayview Realty and Jurien Bayview Realty shall not be liable to the Guest in any respect should the Guest consider the Property to be unsuitable for any reason whatsoever.
Description of the Property
All information in respect of the Property contained in the Booking Agent’s website is believed to be correct at the time of the publication, however all details are subject to change by Jurien Bayview Realty and/the Owner without notice. Jurien Bayview Realty will not accept any responsibility for any alterations to the Property or any part thereof beyond their control or any liability for any matter or occurrences beyond their reasonable control including damage caused by extreme weather conditions, power or water outages, breakdown of appliances, wiring, plumbing, invasion of pests, or any act or omission on the part of the Owner causing loss, accident or injury to the Guest or any one or more of them.
Availability of Property
The short-term accommodation contract negotiated by Jurien Bayview Realty and made between the Guest and the Owner is made on the understanding that the Property and its facilities as stated in the booking confirmation will be available as represented to the Guest. Should any events whatsoever arise beyond the reasonable control of Jurien Bayview Realty which render the Property uninhabitable (for example flood, fire, storm, tempest, etc) or the property becomes for sale or is sold by the Owner, then Jurien Bayview Realty may have to cancel the Guest’s booking for the Property. Should such circumstances arise then Jurien Bayview Realty will endeavour to relocate the Guest to a holiday home of similar standard to the property in the same area. Where this is not possible, Jurien Bayview Realty will refund all monies paid by the Guest in respect of the Property. Upon refund of the monies paid, the guest shall have no further claims whatsoever against the Owner of the Property or Jurien Bayview Realty.
